All states have lemon laws so you are protected if you purchase a new
motor vehicle that is defective. Most states include a provision
in their lemon law that allows for recovery of your reasonable attorney fees in you have a lemon.
In order to prove that you have a lemon, you have to show
that your vehicle suffered a serious defect that the
manufacturer was unable to fix. The defect must show up and
be presented to the manufacturer within a certain time
frame, usually before the end of the first year to
eighteen months of ownership. In addition, the defect must
be substantial, i.e. a problem or defect involving the
transmission, engine, electrical, suspension, brakes
etc... before it can be the basis of a lemon law claim.
(This list is not exclusive by any means, it is merely an
example. Where the defect is a minor problem such as a
mirror or radio, the likelihood that the defect will meet
the criteria under your state lemon law is greatly
decreased.
The manufacturer must
be given a reasonable opportunity to correct the defect(s)
before you can begin a lemon law claim. Typically,
that number is 3 or 4. After the manufacturer fails to
repair the problem, you may be entitled to a full refund of
the purchase price or a free replacement vehicle or cash
compensation. Your relief/remedy depends upon the state law
that you are operating under and the severity of your
vehicle's problems. All of the information that you need can
be found here, whether it is a copy of the state lemon law,
or legal assistance in dealing with your claim. Your one
