Magnuson Moss Warranty Act

Otherwise known as the Federal Lemon Law, the Magnuson Moss Warranty
Act is a law that protects consumers who have purchased defective
products. This law provides protections for consumers who have
purchased warranted products which are defective. The Act
provides for a full refund of the purchase price, or a free
replacement of a consumer product, where the manufacturer
cannot repair the defective product within a reasonable number of
attempts. Per varying interpretations, this number is
typically three or four unsuccessful repair attempts before the
product is considered a "lemon". Lemon Law Attorneys have
successfully used the Magnuson Moss Act to obtain relief for victims
of defective automobiles in a great many instances. The smart
attorney will include a claim under the Magnuson Moss Act for any
state Lemon Law claim that he/she files. Because the Act
applies to any consumer product that originally cost over $25, it
has also been applied to defective motorcycles and RV's. In
addition to providing for a full refund or free replacement product,
the Magnuson Moss Warranty Act sets forth that the consumer shall
obtain his reasonable attorney fees for prosecution of a successful
action.
