Do I need an Attorney?

Technically, you do not need an Attorney to bring a Lemon Law claim.  At this time, we do not know of any state which requires you to hire an Attorney prior to bringing a Lemon Law action.  That being said, if would be unwise to proceed without one.  There is a complexity to the various State Lemon Laws that requires a learned practitioner to pursue claims under them.  There also is the David versus Goliath syndrome, wherein no matter which manufacturer that you go up against, the deck is dramatically stacked in their favor in terms of monies available for pursuing legal action.  Fortunately, most state Lemon Laws provide for recovery of your reasonable Attorney fees if you have a Lemon!  That means that most Attorneys will take on your Lemon Law case without you paying them a dime out of your pocket!  Typically, the Lemon Law Attorney will handle your claim without requesting a cash retainer, and will only get paid if he/she is successful in presenting your claim.  The Attorney will then seek reimbursement from the Manufacturer, and you will not have spent a dime on legal fees. 


Quick Lemon Tips:

  1. Always research a vehicle before buying it.
  2. If your vehicle is defective, notify the dealer promptly.
  3. Make sure your Complaints are written down in your words by the dealer.
  4. Be sure to get a copy of the written Repair Order/Invoice for each dealer service attempt.
  5. Hire a Lemon Law Attorney. In most states, it is completely FREE
